Hard work pays off

Judicare continue to demonstrate their legal prowess as another sentence was passed down from a Spanish court in favour of our clients.

The case was a challenge to the legal team as the basis upon which the claim was made appeared to fall slightly into a grey area of the law, and as such relied heavily upon the arguements presented to the jugde by both legal teams: with Judicare's presentation of facual assesment of the case holding more weight.

Mr & Mrs Joseph explain the route to the life-changing sentence.

"In 2004 an acquaintance of mine informed me that he was going to Spain to view some Villas.  The Villas were under construction and were to be of a high standard of construction and to be built by a well known developer. The site was in Mijas adjacent to the golf course and I decided to accompany my friend on the trip to a presentation.  I was impressed by the presentation and viewed the site and some other properties built by the developer.

I decided to purchase two town houses and I was told at the presentation that I could sell prior to completion and they would market the properties for me.  I was also informed that a bank guarantee was to be put in place with the usual penalty clause included for late completion.

I paid a deposit of 30% to the developer and looked forward to the completion of the development scheduled for February 2006 or before.

The construction turned out to be a nightmare with numerous delays and the developer eventually selling their shares to the construction company. I am quite sure that the solicitors introduced to me by the developers at the presentation did not have my interests as their priority and it seemed that they were acting for the developers.

The development was eventually finished late 2008 by then the property market had drastically declined.  I was not sure what to do about my situation and fortunately i was given the phone number of Judicare group by a third party. I phoned Judicare and gave them the facts of my case. After considering the information that I gave them they said they would be happy to act for me.

Judicare are a very easy company to deal with and they were reasuring to me at a difficult time.

I gave them all the documentation and information they required to challenge the developer in court. We are thrilled to have just received the sentence passed down by the judge in court which will see us receive back all of our original investment of over 250,000€ plus the legal fees and lost interest.

I was very pleased to receive the phone call from Jose Dorta in recent days to tell me that we had won the case and the outcome.
